Una reclamación por lesiones personales es una acción legal emprendida por un individuo que ha resultado herido, ya sea física o emocionalmente, debido a la negligencia de otra parte. Estas reclamaciones pueden presentarse contra particulares, empresas o incluso entidades gubernamentales. Pero todavía a día de hoy existen muchas dudas sobre las reclamaciones por lesiones así como desconocimiento sobre algunos datos. 1 – El plazo de prescripción
Es muy importante tener en cuenta los plazos, ya que cualquier acción legal que tenga por objeto obtener una indemnización deberá emprenderse dentro de los tres años siguientes a la fecha del accidente. Así, aquellos que tuvieron un accidente pero no iniciaron una demanda, pueden hacerlo si aún se encuentran dentro de este plazo de tres años.
En el caso de los menores de edad los tres años empezarán a contar a partir de la fecha de su decimoctavo cumpleaños.
2 – No todos los casos llegan a juicio
Y es que solo tres un 3% de los casos llega a los tribunales. En la mayoría de los casos, las partes suelen llegar a acuerdos extrajudiciales para así minimizar costes y ahorrar tiempo. Un ejemplo de estas acciones extrajudiciales es acordar una compensación con la parte denunciada o su aseguradora.
3 – La Ley de Daños Personales no es solo sobre accidentes de tráfico
También puede tener derecho a recibir una compensación por lesiones personales si, por ejemplo:
- Ha sufrido un accidente en una vía pública provocado por un desperfecto en el asfalto;
- Ha sufrido un accidente en el hogar en la propiedad privada de otra persona;
- Ha sufrido un accidente laboral;
- Ha sido víctima de una negligencia médica.
4 – Necesita un abogado especializado
