Laura Swaine, an Associate at Osbornes Law acted on behalf of a family whose mother was hit by a vehicle as she was crossing the road. The circumstances of the accident were tragic and sadly our client was pronounced dead at the scene. The Defendant’s insurer initially denied liability stating that our client had walked across the road when the green light was shown for the cars. Laura obtained multiple witness statements following receipt of the police report. These witness statements helped to prove that the deceased had crossed at a green light for pedestrians strengthening families case. A settlement for the family was obtained which provided the family with financial security for the future.

Car Park Accident Fatal Claim

Laura Swaine, an Associate at Osbornes Law settled a claim for a pedestrian who was knocked down in a car park by a reversing driver in excess of £260,000.

The Claimant was crossing the road with her friend when the Defendant accidentally reversed knocking into both the Claimant and her friend. The Claimant’s friend tragically died following the accident while the Claimant sustained life-changing injuries including a head injury, ongoing spinal injuries and severe psychological injuries. The Claimant came to Osbornes a year after the accident when it was clear her injuries were far worse than initially thought. Laura obtained privately funded treatment for the Claimant as the Defendant insurer was not willing to engage in any early rehabilitation. The Defendant insurer made numerous low offers in an attempt to scare the Claimant into settling early however the Claimant was guided to continue in her claim.

The settlement reached has allowed the Claimant to return to work part-time to reduce the stress and fatigue due to her brain injury,
