Claim settled for a cyclist hit by a bus at a junction

Laura Swaine recently settled a claim for a cyclist who was struck by a bus while crossing a junction. Laura was able to recover in the region of £60,000 for the cyclist. The cyclist, a self employed business owner, had gone out for his weekend bicycle ride. The cyclist came down a hill and the lights were green for him to proceed when a bus turned right across his path. The cyclist was thrown to the ground with the force of the collision.

Insurance company denies liability

The cyclist suffered a fracture to the left leg which required surgery and a brachial plexus injury. The injury impacted on the cyclists hobbies and he ultimately decided to stop cycling. The insurance company refused to accept liability early on stating that the cyclist was speeding even thought there was no evidence of this.

Laura arranged reports from medical experts

Laura arranged reports from several medical experts including a Consultant Orthopedic Surgeon who specialise in lower limb injuries. The expert stated that the cyclist would require further surgery however he was not eager to undergo it at this stage. A report from a Consultant Psychiatrist was obtained to build up a full picture of the cyclist’s injuries and prognosis.

Laura extracts a settlement which includes compensation loss of potential work

The cyclist had just set up a new company prior to this accident and his injuries prevented him from being able to attend meetings to bring in business. Laura was able to extract a settlement from the Defendant insurer which included compensation for loss of potential work and initial growth to the business.
