Settlement for a client injured at work
Laura Swaine recently settled a claim for a client who was injured while at work. Laura was able to recover a six-figure settlement for a head injury where the client had no loss of earnings and was still working fulltime after the accident.
Client was working in the warehouse when he fell backwards onto the floor
Our client was employed by the Defendant and sometimes had to work in the warehouse. Our client was working in the warehouse where he had to locate some supplies. He was on a step ladder when it slipped causing him to fall backwards onto the concrete floor. When our client was later found, the ladder was on the ground next to him. The ladder had no rubbers attached to the bottom of it to prevent it from slipping. Our client sustained a skull fracture and brain bleed with a few hours of amnesia.
Reduction proposal for contributory negligence
The Defendant’s solicitor initially accepted primary liability but stated that our client did not use the ladder correctly. They proposed a reduction for contributory negligence. Laura requested that they engage a case manager to arrange and fund treatment. The Defendant solicitor ignored this request. Laura then engaged a privately funded case manager who arranged for the client to undergo neurological testing and rehabilitation. This rehabilitation was then recovered upon settlement of the claim.
Reports from neurological medical experts
Laura arranged reports from several neurological medical experts to build up a full picture of the cyclist’s injuries, prognosis and what the future may hold. Negotiations started following receipt of the medical evidence and our client accepted an offer which he believed would help him and his family move forward.
