Osbornes secures a compensation for a client injured after being victim of a bus driver`s negligence

Compensation was recently secured for a passenger on a bus by Megan Lambert, at Osbornes Law, totaling £7,800.

What happened?

Our client was a seated passenger on a bus when the bus driver braked harshly, after moving away from the bus stop, causing all passengers to fly forward, shout and scream.

The sudden braking threw our client from her seat and resulted in her hitting her head on the metal pole in front of her and falling to the ground. She was unconscious for a short time and some passengers assisted her off the ground. Shortly after, the police was called and attended the scene.

The claimant sustained a minor head injury with loss of consciousness, a laceration to her forehead resulting in a scar, facial bruising, a large contusion to her right forearm, a sprained wrist and some minor neuropraxia (mild peripheral nerve injury). In light of her injuries, a report was obtained by a consultant in emergency medicine for a final prognosis. Fortunately, the claimant was anticipated to make a full recovery.

Legal proceedings and compensation

Settlement negotiations began and court proceedings were ultimately issued before settlement was agreed at £7,800.

We often take our safety for granted in public places or on transports, and accidents in these places are more frequent than we think. On the unfortunate occasion in which you are victim of slippery floors, misplaced objects that become obstacles, or as in this case, the negligence of a bus driver, you can end up being injured or seriously injured. In such cases you may be able to make a claim for compensation.

In cases  where an individual sustains injuries on a public bus due to the negligence of the driver, some key details that are helpful to the case are the registration of the bus involved, the route number of the bus and where along the route the accident occurred. Where possible, a description of the bus driver is also very helpful, along with any evidence of travel.

Megan Lambert who represented the client in this case comments:

“I am so pleased that my client was able to make a full recovery from her injuries. Had she been standing on the bus, rather than sitting, her injuries may have been much worse. This case highlights that even in public places or on public transport, where we have a general expectation of safety, incidents happen that can result in us being injured. Our client was absolutely right to seek out advice and we were happy to help here receive the medical treatment she needed whilst at the same time negotiating a financial settlement on her behalf.”
