Fatal claim settled for a cyclist struck by a truck

Laura Swaine recently settled a fatal accident claim for a cyclist who was struck by a truck while on a roundabout. The cyclist, a retiree in their 60s, had been riding home from his daily cycle. He approached the A14 East Bound roundabout in Suffolk and entered the roundabout as it was clear to do so. The Defendant, driving a sand truck, came from the A14 slip road onto the roundabout and collided with the cyclist. Sadly the cyclist died from the injuries sustained.

Insurance company initially denied liability

The insurance company initially denied liability. The Defendant stated that the cyclist was in his blind spot so he should not be found liable for the accident. The police initially decided not to prosecute the Defendant however Laura assisted the family in preparing a response to the police requesting that the evidence be revived. Following this review it was clear that the Defendant should be prosecuted.

After attempting to settle the claim Laura issued court proceedings and negotiations could start

Laura focused on how best to value the claim and looked at what the cyclist did both financially and psychically for his children. After valuing the claim Laura advised the family to look at trying to settle the claim. Insurer was not willing to settle the claim at this stage stating that they were waiting for the criminal proceedings to complete. After attempting to settle the claim Laura issued court proceedings and a solicitor was instructed for the Defendant. Upon reviewing the case the solicitor made an offer of settlement and negotiations could start.

The family accepts an offer but the hole in their lives remain

In the end the family accepted an offer of settlement noting that nothing would bring back the hole in their lives the loss of their dad had caused but this settlement would help towards the financial loss. The family are still waiting for the criminal proceedings before they can bring an end to this difficult part of their lives.
