Collision leads to life changing injuries

Kate Milton, a Senior Associate at Osbornes Law settled a claim for a 27-year-old motorcyclist who was involved in a motorbike accident, in excess of £3 million.

The Claimant was riding his motorcycle along a main road approaching a traffic light-controlled junction. As he went through the junction, the Defendant, travelling in the opposite direction, turned right across the Claimant’s path and collided with him.

Decision to undergo a selective amputation

As a result of the collision, the Claimant suffered life-changing injuries including a severe brachial plexus injury to his right arm. Despite treatment, the Claimant was unable to move his dominant arm and he had constant significant pain. He made the difficult decision to undergo a selective amputation together with targeted muscle rein-nervation.

Specialised rehabilitation programme

The aim of this procedure was to enable him to progress to using a bespoke bionic arm that could be controlled with reinnervated nerves. Kate specialises in amputation claims and was able to obtain interim payments from the Defendant’s insurer to enable the Claimant to embark on a specialised rehabilitation programme to include the fitting of an initial prosthetic limb together with intensive OT and physiotherapy. As the Claimant progressed through his privately funded rehabilitation, he was able to be fitted with a myo-electric bionic limb as well as a cosmetic prosthesis which was skin and colour matched to replicate the Claimant’s tattoos.
