Cyclist obtains a settlement after being struck by a car

Laura Swaine recently settled a claim for a cyclist who was hit by a car pulling into the main road. The cyclist was proceeding down the main road when the Defendant turned onto the road from a side road. The Defendant did not check to see if anyone was on the main road and collided with the cyclist. The cyclist suffered serious facial fractures and damage to his vision along with soft tissue injuries to his leg, hand and shoulder.

Laura arranged reports from several medical experts

The insurance company initially denied liability stating that the Defendant was proceedings correctly. Laura arranged reports from several medical experts including a maxillofacial surgeon and a A&E expert to build up a full picture of the cyclist’s injuries and prognosis. The cyclist had private health insurance and was able to utilise this to undergo early rehabilitation and to see a private Consultant in regards to his facial fractures.

After court proceedings negotiations started

Upon finalising medical evidence Laura approached the Defendant insurer to discuss settlement however they were not willing to do so. Court proceedings were issued and a solicitor was instructed to represent the Defendant. Following a review of the file the Defendant solicitor admitted liability in the Defence and negotiations started.
