Llegamos a un acuerdo para un cliente lesionado en el trabajo
Laura Swaine ha llegado a un acuerdo recientemente para un cliente que se lesionó mientras trabajaba. Laura consiguió un acuerdo de 6 cifras por una lesión en la cabeza, aunque el cliente no tuviera pérdidas financieras y siguiera trabajando a tiempo completo tras el accidente.
El cliente se cayó de espaldas al suelo cuando estaba trabajando en un almacén.
Era empleado del demandado y, a veces, tenía que trabajar en el almacén. Estaba trabajando ahí, buscando unos suministros. Se subió a una escalera de mano, se resbaló y cayó de espaldas en el suelo de cemento. Cuando encontraron a nuestro cliente, la escalera de mano estaba tirada a su lado. La escalera no tenía pies de goma para evitar que resbalara. Nuestro cliente sufrió una fractura craneal y hemorragia cerebral con unas cuantas horas de amnesia.
Propuesta de reducción por negligencia contributiva
Al principio, el abogado de la parte contraria aceptó que el demandado era el principal responsable, pero declaró que nuestro cliente no había usado la escalera correctamente. Propusieron una reducción por negligencia contributiva. Laura solicitó contar con un case manager, una persona encargada de supervisar la rehabilitación de la parte demandante, para organizar y financiar el tratamiento. El abogado del demandado ignoró la solicitud. Laura contrató a un case manager privado que se encargó de que el cliente se sometiera a pruebas neurológicas y rehabilitación. Recuperaron los gastos de la rehabilitación cuando obtuvieron la reclamación.
Informes de expertos en neurología
Laura recopiló informes de varios expertos en neurología para tener un cuadro completo de las lesiones del cliente , el pronóstico y lo que puede suceder en el futuro. Las negociaciones empezaron tras la recepción de las pruebas médicas y nuestro cliente aceptó una oferta que creía que le ayudaría a él y a su familia a seguir adelante.
