Accident at work claim settled for Romanian driver

Siobhan McIvor, a Partner in the Personal Injury Department, has successfully settled an accident at work claim arising from an incident in which a delivery driver sustained a nasty knee fracture whilst trying to lower a pallet truck off the back of a lorry he was trying to unload.
The Claimant’s employer initially refused to provide his insurance details arguing he was not liable for the accident, following which Osbornes Law successfully made a Court application forcing the employer to provide the details requested.
The employer’s insurers, on being notified of the claim, at first denied liability completely on behalf of their insured. After court proceedings were issued, they admitted the insured was liable to some extent however they argued that the Claimant’s compensation should be reduced by 50% and then by 25%, due to the Claimant being “contributory negligent”, that is partly responsible for the accident. On Osbornes Law’s advice the Claimant successfully disputed his compensation should be reduced to such a degree, with the claim eventually settling for a 5-figure sum.
