Detalles del Accidente
Nuestro cliente era un hombre sin hogar de nacionalidad polaca que fue atropellado en un cruce con semáforo, lo que le ocasionó varias lesiones, como una lesión cerebral traumática grave con antecedentes de atrofia cerebral y dependencia del alcohol. Tras el accidente, nuestro cliente tuvo un profundo deterioro cognitivo y se quedó sin la capacidad mental para gestionar sus bienes ni sus asuntos.
Internamiento Inadecuado y Rehabilitación
Cuando el hospital le dio de alta, los servicios sociales le ingresaron en una residencia sin servicios de rehabilitación. Se solicitó la impugnación del internamiento de nuestro cliente en ese lugar, alegando que no se le atendía como era debido porque la residencia no trataba a clientes con lesiones cerebrales ni hablaban polaco. Gracias a esto, nuestro cliente fue ingresado en una clínica privada de rehabilitación para pasar por una rehabilitación intensiva y, después, se le trasladó a una pequeña residencia de ancianos.
Supervisión y Atención Personalizada
Obtuvimos un pago provisional y contratamos a un case manager, una persona encargada de supervisar la rehabilitación de la parte demandante para asegurarse de que el cliente recibía todas las atenciones necesarias. También contratamos a un asistente social que habla polaco para que nuestro cliente participe en actividades y se relacione con la comunidad. Además, conseguimos financiación para contratar terapias psiquiátricas, psicológicas, ocupacionales y fisioterapéuticas.

Conseguimos un acuerdo de 6 cifras para que pueda continuar con su rehabilitación en un futuro y pueda contar con trabajadores que hablen polaco. Kate Milton, socia principal del equipo de lesiones personales, representó a nuestro cliente.
