Our solicitors at Osbornes Law successfully assisted a client in resolving a severe disrepair claim involving water leaks, damp, and mould. The client’s flat was affected by ongoing water penetration, which led to significant damage and made parts of the home uninhabitable.

Leaking overflow pipe

The client began experiencing serious issues with her property due to water penetration caused by a leaking overflow pipe from the flat above. The water continuously cascaded down from the pipe, causing splashback that soaked into the walls and door of the client’s property. The drain surrounding the property, which should have been able to manage the water flow, was overwhelmed by the constant gushing, leaving the property vulnerable to ongoing water damage.

As a result of this issue, the entire flat became damp and mould began to spread throughout the property. The bedroom, which the client shared with her daughter, was one of the worst-affected areas, eventually becoming uninhabitable. The water penetration caused constant puddles in the room, and the back door leading to the garden could no longer be shut securely due to the damage. This compromised the security of the home and made living conditions increasingly unbearable.

Despite the client’s repeated complaints to her landlord, the disrepair issues were not properly addressed, and the situation continued to worsen.

Lack of action from landlord

Frustrated by the lack of action from her landlord, the client turned to Osbornes Law for help. Our solicitors quickly took action, sending a Letter Before Action to the landlord, outlining the severity of the disrepair and the impact it was having on the client and her family. The legal team also pressed for a housing transfer to provide the client with safe and habitable accommodation.

£3,000 in damages

As a result of Osbornes Law’s intervention, the client was eventually decanted from the damaged property and managed to secure a permanent housing transfer to more suitable accommodation. In addition to securing a new home, our solicitors successfully obtained £3,000 in damages for the client as compensation for the extensive disrepair and the suffering she and her daughter endured.

Landlords have a lawful duty to keep in repair the structure and exterior of the property, including drains, gutters, and external pipes. They must also maintain the proper working order of essential services such as water, gas, electricity, and sanitation.
