Background to the Accident
Isidoro Bonilla recently represent his client who sustained serious injuries following a car crash in Spain.
Isidoro’s client was travelling as a passenger in a car on the way to visit friends in Spain. The car he was travelling on overtook another vehicle on a solid white line. This action resulted in a tragic head on collision with another car. Our client sustained a life-changing brain injury in the crash. At the time of the crash, which happened in 2018, the United Kingdom had not yet left the EU and therefore jurisdiction was not an issue. Spanish law was applicable to quantify the damages. Isidoro instructed a Spanish law expert, and a Spanish actuary to calculate losses under Spanish law.
Seven-figure settlement
After full valuation of the claim took place, the parties attend to a Joint Settlement Meeting and Isidoro assisted his client to secure a seven-figure settlement, which rarely occurs when valuing damages under Spanish law.
On the client’s return to the UK, Isidoro was able to secure him interim or early compensation payments. This was important as it paid for the client to undergo multidisciplinary rehabilitation under the care of a brain injury case manager.
Isidoro commented
“Securing early payments is especially important when supporting someone who has suffered a life changing injury. The sooner that individual begins rehabilitation, the better for their future quality of life. An early payment in this case allowed us to appoint a specialist brain injury case manager who provides on-going and long-term support to those who have suffered a brain injury.”
Despite Brexit and its jurisdictional pitfalls, claims arising out of accidents abroad need to be considered on a one-to-one basis. Isidoro Bonilla is an expert in private International law, especially in claims involving foreign jurisdictions and foreign elements. Isidoro will be able to advise on whether you can make a claim for an accident abroad.
