Se resuelve la reclamación por la muerte de un ciclista atropellado por un
camión

Laura Swaine hace poco consiguió un acuerdo para la reclamación de un ciclista que fue atropellado por un camión en una rotonda. El ciclista, un hombre jubilado de unos 60 años, volvía a casa después de su paseo diario en bici. Se acercó a la rotonda de la A14 East Bound en Suffolk y se metió cuando estaba despejado para hacerlo. El demandado, que iba conduciendo un camión de arena, entró en la rotonda desde la salida de la A14 y colisionó con el ciclista. Tristemente, el ciclista falleció a causa de las heridas provocadas por el accidente.

Al principio, la aseguradora negó responsabilidad. La parte contraria declaró que el ciclista estaba en su ángulo muerto y no debería considerarse responsable del accidente. Al principio, la policía decidió absolver al demandado, pero Laura ayudó a la familia a preparar una respuesta a la policía solicitando que se volviera a abrir el caso. Tras volver a revisar las pruebas estaba claro que el demandado debería ser procesado.

Después de intentar llegar a un acuerdo, Laura inició los procedimientos judiciales y pudieron comenzar las negociaciones

El principal objetivo de Laura fue valorar la reclamación, teniendo en cuenta lo que el ciclista hacía por sus hijos tanto económicamente como físicamente. Tras valorar la reclamación, Laura aconsejó a la familia que intentara llegar a un acuerdo. La aseguradora no estaba dispuesta a negociar en ese momento y afirmó que estaban esperando a que finalizara el proceso penal. Después de intentar llegar a un acuerdo, Laura inició los procedimientos judiciales y la parte contraria instruyó a un abogado. Tras revisar el caso, el abogado hizo una oferta y comenzaron a negociar.

La familia acepta la oferta, pero no llena el vacío que hay en sus vidas.

Al final, la familia aceptó la oferta de la reclamación y señalaron que nada llenaría el vacío que la pérdida de su padre había producido en sus vidas, pero que este acuerdo ayudaría a paliar la pérdida económica. La familia sigue esperando al proceso penal antes de poner fin a esta época de sus vidas tan complicada.
